First-Year Performance Guarantee - Painting

| Damage to painted surfaces after painting contractor completes job | Example 1: Specifications
require that the painting be completed prior to installation
of carpeting. The contractor, while installing the carpeting,
damages the newly painted surfaces of the walls and trim.
The floor covering contractor is responsible for the cost
of repairing the damage. Example 2: Electrical contractor finds that a wall outlet has been improperly placed. Correction requires moving outlet to proper location, followed by patching hole and replacing wall to match. Electrical contractor is responsible for cost of patching and repainting vacated outlet space. |
Refinish damaged area and cost of refinishing shall be paid by the contractor responsible for the damage. |
| Exterior paint or stain peels or deteriorates | Exterior paints or stains should not fail during the first year of ownership. | Properly prepare and refinish affected areas, matching color as closely as possible. Where finish deterioration affects the majority of the wall or area, the whole area should be refinished. |
| Painting required as corollary repair because of other work | Necessary repairs under this standard should be refinished to match surrounding area as closely as possible. | Refinish required area as necessary. |
| Deterioration of varnish or lacquer finishes | Natural finishes on interior woodwork should not deteriorate during the first year of ownership. | Interior paint | Interior paint should be applied in a manner sufficient to visually cover wall and ceiling surfaces where specified. | Retouch wall, ceiling or trim surfaces where inadequate paint has been applied to cover original surfaces. Paint deterioration caused by normal living conditions; i.e., repeated scrubbing or scouring is a maintenance item and the responsibility of the homeowner. |
