1. Referrer must personally escort Homebuyer to the
Sales Office and introduce Homebuyer to a Sales Representative on Homebuyer's
first visit to the Sales Office ("First Visit") of ____________________
("Community") in order to qualify for the Referral Fee.
2. Homebuyer must enter into the Master Customer Agreement ("Purchase
Agreement") for the Property within 90 calendar days of the First Visit date.
Execution of the Purchase Agreement by Homebuyer and by the Sales
Representative constitutes only an offer to purchase by Homebuyer and is not
binding until the Purchase Agreement has been accepted by Seller under the
terms of the Purchase Agreement.
3. During Homebuyer's First Visit, Referrer and Homebuyer must fully
complete a Fieldstone Referral Form to be provided by a Sales Representative.
No other form of registration will be accepted by Seller.
4. Upon Homebuyer entering into a Purchase Agreement, the Friends & Family
Referral Fee Authorization and W9 must be signed by Homebuyer and Referrer and
submitted to Seller. Referrer will receive the Referral Fee from the Escrow
Company approximately seven (7) days after Homebuyer's Close of Escrow. Seller
has no obligation to pay the Referral Fee until these forms are completed and
returned to the Sales Office.
5. Should a Homebuyer purchase more than one (1) home within the Community
from Seller based on the referral from the Referrer, Seller will pay a
Referral Fee for each home purchased up to a maximum of three (3) Referral
Fees. A maximum of three (3) Referral Fees may be paid to a Referrer.
6. If the Homebuyer is represented by a Licensed Real Estate professional,
Referrer is not eligible to receive the Referral Fee.
7. To participate in the Fieldstone Friends and Family Referral Program,
Referrer must warrant and represent that he or she is not engaged in the
business of providing settlement services nor did he or she solicit a referral
or engage in any marketing activities or other settlement service activities
in connection with a referral subject to the Referral Fee.
8. Fieldstone Friends and Family Referral Program is subject to change or
cancellation without prior notice. However, once Homebuyer and the Sales
Representative have signed the Fieldstone Referral Form and Homebuyer and
Seller have entered into a Purchase Agreement within the 90 calendar day
period referenced above, Referrer is entitled to receive the Referral Fee at
Close of Escrow, should this program change or cancel prior to Homebuyer's
close of escrow.
